Terms of Service

1. Eligibility

To access and use the Service, you must be at least 18 years of age. By engaging with the Service, you affirm and warrant that you meet this minimum age requirement, and that you are legally competent to enter into and abide by these terms.​

Additionally, you represent and warrant that you are not restricted or prohibited from using the Service under any applicable laws, including but not limited to the laws of the United States, as well as the legal requirements of your country or region of residence. This includes ensuring that your use of the Service does not violate any sanctions, trade restrictions, or other legal prohibitions that may apply to you.​

Beyond meeting these eligibility criteria, your use of specific features of the Service—including video chats and voice posts—requires strict adherence to our community rules. For video chats, this means maintaining respectful and appropriate conduct at all times: refraining from sharing explicit, violent, or harassing content; respecting the privacy and boundaries of other participants; and avoiding any behavior that could cause discomfort or harm to others in the chat.​

When creating or interacting with voice posts, you must similarly abide by community guidelines, such as refraining from posting hate speech, threats, misinformation, or copyrighted material without authorization. All voice content should be respectful, non-harmful, and compliant with the overall spirit of the Service’s community standards.​

Failure to comply with these rules may result in restrictions on your use of the Service, up to and including account termination, at our sole discretion. By using the Service, you acknowledge your understanding of and commitment to these eligibility requirements and community guidelines.

2. Account Registration

To access certain features of the Service, you may need to register for an account. When registering, you agree to:

• Provide accurate, current, and complete information about yourself;
• Maintain and promptly update your account information to keep it accurate;
• Keep your password secure and confidential;
• Notify us immediately of any unauthorized use of your account;

3. Use of the Service

• Attempt to gain unauthorized access to any portion of the Service or any other user's account;
• Collect or store personal data about other users without their express consent;
• Use the Service for any commercial purpose without our prior written consent.

4. Intellectual Property

The Service and all content thereon, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, are the property of Hipub or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only. This license does not include any right to:

• Reproduce, distribute, or publicly display any content from the Service;
• Modify, adapt, or create derivative works from the Service;
• Use any data mining, robots, or similar data gathering or extraction methods;
• Use the Service for any commercial purpose.

All trademarks, service marks, and trade names are the property of their respective owners.

5. User Content

Your ownership of all content you post, upload, or transmit through the Service (hereinafter referred to as "User Content") remains fully intact. This means you retain all intellectual property rights, including but not limited to copyrights, trademarks, and any other proprietary rights associated with such content.​

However, by choosing to share User Content through our Service, you hereby grant us a comprehensive license to utilize this content in ways that are essential to the operation and growth of our platform. Specifically, this license is worldwide, non-exclusive (meaning you can share your content elsewhere without restriction), royalty-free (no payment is owed to you for our use), sublicenseable (we may authorize trusted partners to assist in providing the Service), and transferable (this license can be passed on in the event of a merger, acquisition, or similar business transaction). The scope of this license includes using, reproducing, distributing, creating derivative works from, displaying, and performing your User Content—all solely in connection with operating the Service and conducting our legitimate business activities.​

To ensure a safe, respectful, and compliant community for all users, you must adhere to the following obligations when posting User Content:​

• Ownership and Authorization: You warrant that you either own all rights to the User Content or have obtained all necessary licenses, permissions, consents, and releases from third parties (including but not limited to copyright holders, individuals featured in the content, or other rights holders) to post, transmit, and allow the Service to use the content as outlined in these terms. This includes ensuring that any content featuring minors, celebrities, or private individuals has been properly authorized.​
• Compliance with Laws and Terms: Your User Content must strictly comply with these Terms of Service, our Community Guidelines, and all applicable local, national, and international laws, regulations, and treaties. This prohibits content that violates laws related to defamation, harassment, discrimination, privacy, intellectual property infringement, obscenity, child exploitation, terrorism, hate speech, or any other illegal activity.​
• No Harm to Others: You agree that your User Content will not cause physical, emotional, financial, or reputational harm to any individual, group, or entity. This includes avoiding content that incites violence, promotes self-harm, engages in cyberbullying, spreads false information (misinformation or disinformation) that could harm public health or safety, or violates the privacy of others (such as sharing non-consensual intimate images, personal contact information, or confidential data).​

Examples of prohibited User Content include, but are not limited to:​

• Hate speech, slurs, or content that dehumanizes individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.​
• Threats, harassment, or bullying directed at any user or group.​ Pornographic, sexually explicit, or adult content (unless explicitly permitted by the Service’s guidelines for specific categories).​
• Content that promotes illegal activities, such as drug trafficking, fraud, or violence.​
• Copyrighted material (e.g., movies, music, books) that you do not have the right to share.​
• False information about public health crises, elections, or other critical topics that could mislead or harm others.​
• Non-public personal information (e.g., addresses, phone numbers, financial details) of others without their consent.​

We reserve the right, in our sole and absolute discretion, to review, monitor, and remove any User Content that violates these terms, our Community Guidelines, or is otherwise deemed objectionable. This includes content that we reasonably believe could damage the Service’s reputation, disrupt the user experience, or expose us to legal liability. We may also take additional actions, such as restricting your access to the Service, suspending or terminating your account, or cooperating with law enforcement, if your User Content repeatedly violates these rules or causes significant harm.​

By using the Service, you acknowledge that we are not obligated to pre-screen User Content but may do so at our discretion. Your continued use of the Service constitutes your agreement to these terms and your commitment to upholding a positive community environment.

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, in our sole discretion.

6. Privacy

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Hipub DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Hipub does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. You use the Service at your own risk.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Hipub SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (D) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY; (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND (F) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY.

IN NO EVENT SHALL Hipub'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO Hipub, IF ANY, FOR ACCESSING THE SERVICE DURING THE PAST TWELVE (12) MONTHS.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hipub, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your User Content.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. When we do, we will post the revised Terms on this page and update the "Last Updated" date. Your continued use of the Service after the revised Terms are posted constitutes your acceptance of the revised Terms.

11. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Los Angeles, California, and you consent to the jurisdiction of such courts.

13. Entire Agreement

These Terms constitute the entire agreement between you and Hipub with respect to the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, with respect to the Service.
